Since the implementation of the visa waiver program by the American government, traveling to the United States has become easy. However, one should not think that it is possible to enter American soil without any document or prior authorization. American authorities take internal security very seriously, and all travelers exempt from tourist visas must still prove their credentials before even presenting themselves at the border post. What is the concrete purpose of ESTA?

Aware that the procedures for entering American territory needed to be simplified to ensure the sustainability of tourism and business, the American government decided it was time to change things and established the visa waiver program.

The list of countries affected by this program is always subject to change according to diplomatic relations between the USA and its allies. Since 2025, 41 countries are members, and nationals of these countries no longer need to apply for a USA visa. This application previously required a visit to the American embassy, involved long waiting times, and also significant costs.

ESTA serves as a sort of replacement for the traditional visa application, with the difference that the obtaining procedure is much simpler and faster, as it is done exclusively through an online application. Demonstrating that the traveler meets the requirements of the VWP, that’s what ESTA is for.

What specific conditions does ESTA serve to demonstrate?

To be able to benefit from the ESTA authorization, it is necessary to meet the requirements of the Visa Waiver Program. The required conditions concern both the traveler themselves and their stay.

Only nationals of signatory countries are entitled to make an ESTA application. A restriction applies, however, for travelers with dual nationality, including Syrian, Iraqi, Iranian, or Sudanese nationality. Moreover, the applicant must demonstrate that they are not a threat to American internal security by answering a series of questions about their criminal history, health status, affiliation with terrorist organizations, etc. This questionnaire is part of the ESTA form, which is the authorization request form. You will find it on the official US government website or on any other private site offering to make the ESTA application on your behalf.

ESTA also precisely determines the type of stay authorized. It can only be a tourist stay, a business trip, or transit by air or sea. The stay is also limited in time, as ESTA only covers a temporary stay of up to 90 days.

An additional condition to be met, which is not directly related to the VWP but to any travel to the USA in general: possession of a valid passport. The passport in question must also be an electronic passport or a biometric passport. This is explained for security reasons and makes a lot of sense for ESTA since it is electronically linked to the electronic chip contained in these passports. It should be noted that the French passport meets this requirement and that any new passport issued in France is a biometric passport.

Does ESTA replace the American visa?

The ESTA authorization does not have the legal scope of a USA visa and cannot replace it. It is an electronic travel authorization implemented as part of a visa waiver agreement.

For anyone who cannot obtain an ESTA, whether they are ineligible or their trip is not suitable (working in the USA, doing an internship there, studying at an American university, etc.), a visa application is required. This is done at the United States embassy after completing an online form and preparing all the necessary supporting documents.
